PROSECUTORS have dropped the case against a driver fined for blowing his nose.
Michael Mancini was stunned when he was issued with a fixed penalty notice in stationery traffic.
But he refused to pay the £30 ticket he was slapped with in Ayr High Street and vowed to fight the case in court.
Now the district procurator fiscal has written to businessman Michael’s lawyer confirming that the matter is not to be pursued.
In a letter to solicitor Peter Lockhart, Miriam Watson said: “After further enquiry and careful consideration of all the facts and circumstances I have decided to take no further action in respect of this matter.”
Michael, 39, was given the fine after clearing his sinuses in his Mercedes van.
The dad-of two, who runs a furniture restoration business with his brother Philip, claimed that he had his handbrake on and his van in neutral.
But officers said that he was not in proper control of his vehicle when he produced a tissue and blew his nose.
Mr Lockhart wrote to the procurator fiscal saying that it “beggars belief” this had happened.
After receiving confirmation the case was being dropped, Mr Lockhart said: “I’ve phoned Mr Mancini to tell him the good news. He is absolutely delighted and I am pleased for him. This is a sensible solution.”
